Proposal Terms and Conditions - Reference Language

This document provides the standard acceptance language to be included on every PCSI Proposal. It should appear in a clearly visible, boxed section of the proposal - ideally immediately above the Customer signature or approval line. Select the correct version based on the service category.


 VERSION A - Monitoring, Testing and Inspection Proposals

Insert the following boxed text on every monitoring, testing, or inspection proposal:

By approving this Proposal - whether by written signature, electronic confirmation, issuance of a Purchase Order, or authorization to commence services, Customer agrees to be bound by Pyro-Comm Systems, Inc.'s Terms and Conditions, Version 1.0 (May 2026), which are incorporated herein by reference. IMPLEMENTATION NOTES FOR PCSI TEAM

Website Hosting.  Each T&C document should be hosted at a stable, permanent URL. Create a landing page at www.pyrocomm.com/terms with links to all three versions, clearly labeled. The URL for each version should not change after publication, as it will be referenced in executed agreements.

Version Control.  Each T&C set is stamped Version 1.0 / May 2026. When updates are made, increment the version number and effective date and archive all prior versions. The version in effect at the time a proposal is approved governs that agreement.

QR Code (Optional).  Consider adding a QR code to each proposal linking directly to the applicable T&C page. This makes it easy for customers to review on a mobile device and reinforces that the terms are intended to be read.

Conspicuousness.  California courts have enforced incorporated-by-reference T&Cs where the reference is clear and conspicuous. The boxed reference block is designed to be visually distinct. Do not bury this language in small print at the bottom of a multi-page proposal.

Proposal System.  When the terms URL is finalized, update the Proposal template in BuildOps (or the applicable proposal system) so that the correct reference block populates automatically based on service category.

Legal Review.  These drafts are prepared for ownership review and internal discussion. Prior to deploying for use with customers, PCSI should have the T&Cs reviewed by qualified California legal counsel, particularly with respect to the limitation of liability, indemnity, liquidated damages, and dispute resolution provisions.
